Intsell Terms of Use
These Terms govern the Intsell app installed on a Shopify store.

1. Parties, Acceptance, and Scope
These Terms form an agreement between Yılmaz Kok, the provider of Intsell ("Intsell"), and the person installing or using the app for a Shopify store or the business that person represents (the "User" or "Store"). Installing or continuing to use the app constitutes acceptance of the current Terms. Questions may be sent to info@intsell.co.uk.
The User represents that they are authorized to act for the Store and authorize store personnel. Mandatory consumer and data-protection rights remain unaffected.
2. The Service
Intsell enables store staff to create private, expiring selections from exact Shopify catalogue variants, display them by QR code or link, and open one complete Online Store cart after live revalidation.
Intsell is not a payment institution, marketplace, order-acceptance system, or replacement for Shopify checkout. Product sales, price commitments, stock, delivery, returns, warranties, and the customer sales relationship remain the Store's responsibility.
3. Accounts, Authorization, and Security
The Store must provide Shopify Admin access only to authorized staff and promptly remove access through Shopify when a person's authority ends. Shopify user accounts and credentials must not be transferred.
Suspected unauthorized access or a security incident must be reported promptly to info@intsell.co.uk and, where appropriate, Shopify. Intsell may temporarily restrict an installation or access to protect the service.
4. Shopify Plan and Charges
Available Intsell plans, trial periods, and applicable charges are shown by Shopify before plan approval.
Intsell creates no charge unless Shopify App Pricing is enabled and the Store accepts the plan on Shopify's approval screen.
5. Store Content and Intellectual Property
The Store represents that it has the rights required for product images, logos, brand assets, prices, descriptions, and other content it makes available to Intsell through Shopify, and that the content is accurate, current, and lawful.
The Store grants Intsell a non-exclusive, purpose-limited license for the service period to host, technically reproduce, transform, and display the content in selections. Ownership remains with the Store or the relevant rights holder.
6. Personal Data
Platform-user data is processed under the Privacy Notice for Platform Users. If the Store enters an optional customer name or note, the Store is the controller and is responsible for providing required information, identifying a legal basis, and responding to data-subject requests.
Intsell processes the customer name or note as processor under the Data Processing Addendum. Special-category data, health data, identity numbers, payment-card data, and unnecessary contact details must not be entered into free-text fields.
7. Availability and Changes
Intsell uses reasonable technical and organizational efforts to keep the service secure and available. The service is not warranted to be uninterrupted, error-free, or suitable for a particular commercial outcome. Maintenance, security events, infrastructure failures, or force majeure may cause temporary interruptions.
Material changes affecting the essential nature of the service or User rights are communicated within a reasonable period. Changes requiring renewed contractual acceptance are presented separately for acceptance.
8. Suspension and Termination
Intsell may proportionately restrict content or suspend an installation temporarily or permanently for unlawful use, a security risk, infringement of third-party rights, abuse of plan or service limits, or a material breach. Where practicable, the reason and a remediation opportunity are provided.
The Store may uninstall the app through Shopify Admin or send a deletion request to info@intsell.co.uk. Except for legally required records and dispute evidence, Store content is deleted under the Retention and Store Deletion Policy after authority is verified.
9. Limitation of Responsibility
Intsell is not responsible for the Store's products, prices, inventory, customer communications, or sales transactions. Neither party is responsible for delay caused by an event outside its reasonable control that it could not reasonably prevent.
To the extent permitted by mandatory law, Intsell is responsible for indirect loss, loss of profit, or data loss arising from the service only to the extent caused by its wilful misconduct or gross negligence. Nothing excludes liability that cannot lawfully be limited.
10. Governing Law and Entire Agreement
These Terms are governed by the laws of the Republic of Turkey, subject to mandatory jurisdiction rules. If any provision is invalid, the remaining provisions continue in effect. The Data Processing Addendum and Acceptable Use Rules form part of these Terms.
